Abstract

This article addresses the legal protection of the transindividual rights of the elderly, highlighting the importance of ensuring a dignified and participatory old age through effective public policies and judicialization as a complementary mechanism. The research analyzes Brazilian legislation, especially the Elderly Statute (Law No. 10,741/2003) and the Federal Constitution of 1988, highlighting the importance of collective and diffuse rights that directly impact the quality of life of the elderly population. The study points out the advances and gaps in the implementation of public policies aimed at the elderly, identifying the need to strengthen these actions to overcome the challenges related to infrastructure, professional training and monitoring. The judicialization of the rights of the elderly is presented as an essential tool for the realization of these rights, although it should not be seen as the definitive solution to structural flaws. It is concluded that the realization of the transindividual rights of the elderly requires a collective commitment, involving the State, society and family, aiming at the promotion of a dignified and inclusive old age.

Dny Sandra da Silva Souza, FEDERAL UNIVERSITY OF RONDÔNIA

She holds a degree in Law and Accounting from the Federal University of Rondônia and a degree in Administration from the University of Cuiabá. She is currently pursuing a master's degree in Administration and Accounting from the Federal University of Rondônia. She holds a postgraduate degree in Public Administration from the Lapa Educational Faculty and a postgraduate degree in Constitutional Law from the Dr. Edmundo Ulson University Center of Araras (UNAR). Her professional experience includes Retail Management, having managed the Colcci Norte franchises (Manaus, Cuiabá and Rondônia). She is currently a civil servant at the City Hall of Cacoal - RO, working in the area of ​​Administration and Accounting. Her academic and professional interests are focused on the dialogue between Management Sciences, with special emphasis on Law, Administration and Accounting Sciences, with a focus on Governance and Public Transparency.
